January 9, 2013 - Clean Air Council Issues Notice Of Intent To Sue Noram Seating, Inc. for Operating Wood-Fired Boiler with Expired Operating Permit
On January 9, 2013, the Clean Air Council issued a notice of intent to file a federal Clean Air Act citizen suit against Noram Seating, Inc. for operating a wood-fired boiler with an expired operating permit.
Under Pennsylvania law, a facility must renew its operating permit once every five years. To receive protection under Pennsylvania’s permit shield law, a facility must submit a complete renewal application at least six months prior to a permit’s expiration date. Noram Seating, Inc. failed to submit a complete renewal application within six months of its renewal deadline, and its operating permit has expired. As a result, Noram Seating, Inc. is operating its facility with an expired operating permit.
